ZMARTBUILD SPC Flooring– Warranty Policy

Product Name: ZMARTBUILD SPC Flooring 
ZMARTBUILD warrants to the original purchaser that its ZMARTBUILD SPC flooring is free of manufacturing defects from the date of purchase for the length of time specified for the product. A defect is defined as shortfall in the product to perform to specifications. The warranty also states that for the length of the warranty the surface will not wear through to the décor under normal use. This flooring is to be used in indoor, dry, climate-controlled areas only. The warranty applies to the original purchaser only and is non-transferable.

ZMARTBUILD SPC Flooring has limited residential warranty* 15 year and 5 years limited commercial.

• Manufacturing Defects Warranty: ZMARTBUILD ensures that your floor will be free of manufacturing defects with in period of warranty.

• *Waterproof Warranty: ZMARTBUILD SPC flooring is the next-generation flooring that is fortified with proprietary wet protection systems that enables it to be installed in areas prone to exposure to moisture. ZMARTBUILD warrants to the original residential purchaser that the floor will not swell significantly from exposure to moisture due to everyday household cleaning and spills that are taken of as per the Care & Maintenance instructions.

• Petproof Warranty: ZMARTBUILD SPC flooring warrants to the original residential purchaser and individual homeowner, that the floor will resist staining caused by pet stains. Stain resistance provides to minimize permanent stains for the warranty period, so long as the homeowner adheres to the required protocols as outlined in the Care & Maintenance guide. Accidents need to be cleaned up promptly upon discovery and should not be allowed to be in contact with the flooring for over 24 hours. Prolonged exposure to the accidents will result in progressively greater difficulty in their removal. Damages beyond staining of the floor-covering product is not covered.

• Wear Resistance Warranty: ensures your floor will not wear through the protective wear layer under normal household conditions and if maintained according to the guidelines provided.

• Household Stain Resistant Warranty: ensures that your floor will not permanently stain from common household products, excluding permanent marker, permanent dyes & finishing stains

>> Improper installation: Noncompliance with installation guidelines as set forth by ZMARTBUILD. This includes issues relating to installing the wrong product, unsuitable sub-floor, improper conditioning of jobsite and flooring material, technique, improper adhesives, exposure to extreme temperatures and sunlight during installation, improper spacing, planks that have not been fully engaged during locking resulting in gaps, etc.

>> Improper Use or Abuse: Includes issues from mishandling the product, physical or chemical abuse, improper care and maintenance, high heels, pet nails, installing residential product in a commercial environment, etc.

Events beyond everyday household spills including but not limited to, leaks from appliances and plumbing, flooding, excessively wet maintenance, standing water (water that remains on the floor).

Fading or decolorating of other damage uder to excessive temperature of sunlight. Flooring installed on stair. Damage caused by water or moisture in the sub roof or underneath the flooring. Flooring that is not maintained in accordance with ZMARTBUILD care and maintenance guidelines.

ZMARTBUILD disclaims any and all other warranties, express or implied, including but not limited to, warranties of merchantability or fitness for a particular purpose.

ZMARTBUILD is a manufactured product and is subject to variations due to an inherent variability in raw materials and production processes. Certain tiles may have higher levels of variations. All material should be inspected prior to installation. Visual defects or nonconformities apparent prior to installation will void this warranty. All warranty claims must be reported immediately. Failure to report the warranty claim within 14 days of defect discovery will void this warranty.

ZMARTBUILD liability under any theory of liability (whether contract, tort, strict liability or otherwise) shall be limited to the sole and exclusive remedy of replacement of defective goods FOB ZMARTBUILD facility or, at ZMARTBUILD option, refund of the purchase price of such defective goods. If product is unavailable or discontinued, ZMARTBUILD reserves the right to select and supply similar material. The warranty does not cover all other costs, incidental and consequential damage including loss of use of the property.

Buyer acknowledges and agrees that the foregoing conditions and limitations are an essential basis for Buyer’s agreement with ZMARTBUILD. Any suit or other legal action that the Buyer may bring against ZMARTBUILD arising out of the sale of this tile must be filed within 14 days from the date of Zmartbuild alleged breach. Buyer’s failure to file within this stipulated period shall be deemed to act as waiver and time bar for any and all claims against ZMARTBUILD.com.

This warranty gives you specific rights and you may also have other rights, which vary from state to state.

What is NOT Covered by this Warranty

1. Product sold by the manufacturer as other than “first quality.”

2. Improper Installation: Installation is done by a third-party installer, who is not a ZMARTBUILD  Certified Installers.

3. Improper Installation: Material installed not in accordance with ZMARTBUILD SPC flooring recommended Installation practices, including any and all problems caused by the use of non-recommended underlayment and/or preparation of the substrate are not warranted.

4. Installing four plank corners together is not recommended for click products and therefore will not be warranted. Installation errors are not manufacturing related conditions. ZMARTBUILD does not warrant installer workmanship.

5. ZMARTBUILD will not pay for labor costs to repair or replace material with visible conditions that were apparent before installation.

6. Improper maintenance, which results in loss of gloss or buildup of a dulling film.

7. Damage resulting from neglect or misuse of strong detergents, chemicals, corrosives; including but not limited to stains from paints, dyes, mats, fertilizers or other similar materials.

8. Damage caused by moving appliances or heavy furniture without protecting the floor. (Always protect floor by using plywood or hard board runways when moving heavy objects and also when using an appliance trolley, heavy objects equipped with wheels or rollers, including two- and four-wheel carts etc.)

9. Damage resulting from accidents (including trip and fall), casualty events, abuse or improper usage (including pet related damage, such as chewing, digging, clawing, etc.). Accidents, abuse and improper usage are defined as, but are not limited to damage caused by – casters** on furniture, rotating beater bars on vacuum cleaners, burns, cuts, impact from heavy and sharp objects, narrow or spike heels, cleats, etc., as well as, damage resulting from unprotected furniture legs.

10. Damage caused by rolling loads or wheel chairs (motorized and non-motorized).

11. Damage caused by appliances or plumbing leaks.

12. Damage or neglect during transportation.

13. Damage arising because the flooring is installed in an outdoor area, a solarium, a porch, a garage or areas similar to all of these.

14. Damage caused by a natural disaster.

15. Fading, discoloration, or other damage due to excessive temperatures, burning flame or sunlight. Room Temperature must not exceed 113 ° F (48°C).

16. Problems or damage due to excessive moisture or hydrostatic pressure from the sub-floor including pH levels outside the ZMARTBUILD Installation Guidelines.

17. Discoloration caused by use of latex or rubber-backed floor mats. Note that some synthetic backed carpets contain latex in the manufacturing process that may discolor your Tiles flooring. Always use mats marked as “non-staining.”

18. Damage caused by remodel or construction related activities.

19. Flooring installed on stairs/ escalators is excluded from warranty coverage.

20. Discoloration caused by rubber pads, rubber wheels, rubber tires, rubber rollers, automotive tires, etc.

21. Installation of residential product in a commercial environment. ZMARTBUILD recommends installation residentially warranted product only in a residential setting.

22. Re-installation of an already installed product, is not covered by warranty terms.

23. Products should only be installed on the floor (horizontal surface installation). Installation on any other surface (vertical or ceiling installations) is not covered under the warranty terms.
